1. Introduction and Acceptance

Welcome to That Lovely Box ("Service", "Platform", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Maradin, a company registered in the Netherlands, governing your access to and use of the That Lovely Box platform.

By creating an account, making a purchase, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

2. Description of Service

That Lovely Box is a digital gift platform that enables users to create personalized digital gift boxes containing messages, photographs, videos, and documents. These gift boxes can be scheduled for delivery and sent to recipients via email.

2.1 Service Features

• Single Box: One-time digital gift box for €9.95 (VAT included)
• Sequence: Up to 10 scheduled boxes for €14.95 (VAT included)
• Rich content support (text, images, videos, PDFs)
• Scheduled delivery with countdown
• Opening notifications
• Anonymous sending option

2.2 Service Limitations

• Maximum file size: 50MB per box
• Supported formats: Common image, video, and document formats
• Recipients must have a valid email address

3. Account Registration

3.1 Eligibility

To use our Service, you must be at least 16 years of age and capable of entering into a legally binding agreement. By registering, you represent and warrant that you meet these requirements.

3.2 Account Security

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities conducted through your account
• Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Pricing and Payment

4.1 Pricing

All prices displayed on our platform are in Euros (€) and include applicable VAT:

• Single Box: €9.95 per box
• Sequence: €14.95 for up to 10 boxes

We reserve the right to modify our pricing at any time. Price changes will not affect orders already placed and paid for.

4.2 Payment Processing

Payments are processed securely through our payment provider, Lemon Squeezy. We do not store your payment card details on our servers. By making a purchase, you also agree to Lemon Squeezy's terms of service.

4.3 Payment Confirmation

Upon successful payment, you will receive an email confirmation. Your gift box will be created and scheduled for delivery according to your specifications.

5. Refund Policy

5.1 General Policy

Due to the digital nature of our Service, all purchases are generally considered final once the gift box has been sent to the recipient. We encourage users to review their content carefully before confirming delivery.

5.2 Eligible Refunds

Refunds may be issued in the following circumstances:

• Technical failures: If a technical issue on our end prevents the recipient from accessing the gift box
• Duplicate charges: If you were charged multiple times for the same order due to a system error
• Service unavailability: If we are unable to deliver the Service as described

5.3 Non-Eligible Refunds

Refunds will not be provided for:

• Change of mind after the box has been sent
• Incorrect recipient email addresses provided by the user
• Content errors made by the user
• Recipients who choose not to open the box

5.4 Refund Process

To request a refund, please contact us at hello@thatlovelybox.com within 14 days of your purchase, providing your order details and reason for the refund request. Approved refunds will be processed within 5-10 business days.

6. User Content and Conduct

6.1 Content Ownership

You retain all ownership rights to the content you upload to our platform. By uploading content, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.

6.2 Content Responsibility

You are solely responsible for all content you upload and share through our Service. You represent and warrant that you have all necessary rights to use and share such content.

6.3 Prohibited Content

You agree not to upload, share, or transmit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Contains explicit adult or sexual material
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates the privacy rights of others
• Promotes violence, terrorism, or illegal activities
• Contains spam or unauthorized advertising

6.4 Prohibited Activities

You agree not to:

• Use the Service for unsolicited communications or spam
• Harass, intimidate, or threaten any person
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission

We reserve the right, but are not obligated, to review, refuse, or remove any content that violates these Terms or that we find objectionable, without prior notice.

6.6 Disclaimer of Liability for User Content

That Lovely Box does not endorse, verify, or assume any responsibility for user-generated content. We are not liable for any content created, uploaded, or shared by users through our Service, including any damages, claims, or losses arising from such content. Users who receive gift boxes acknowledge that the content within is created solely by the sender, and That Lovely Box bears no responsibility for its accuracy, legality, or appropriateness.

7. Intellectual Property

7.1 Our Intellectual Property

The That Lovely Box name, logo, website design, and all related trademarks, service marks, and intellectual property are owned by Maradin. You may not use our intellectual property without our prior written consent.

7.2 License to Use Service

We grant you a limited, non-exclusive, non-transferable license to access and use our Service for its intended purpose, subject to these Terms.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By using our Service, you consent to the practices described in our Privacy Policy.

9. Service Availability and Modifications

9.1 Availability

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 Modifications

We reserve the right to modify, update, or discontinue any aspect of our Service at any time. For significant changes that affect existing users, we will provide reasonable notice where practicable.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARADIN AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Maradin and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Account Termination

13.1 Termination by You

You may terminate your account at any time by deleting it through the account settings page or by contacting us. Upon termination, your right to use the Service will cease immediately.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, us, or third parties.

13.3 Effect of Termination

Upon termination, we will delete your account data in accordance with our Privacy Policy. Gift boxes that have already been sent to recipients will remain accessible to recipients according to the original delivery terms.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at legal@thatlovelybox.com to attempt to resolve any dispute informally. We will endeavor to resolve disputes within 30 days.

14.2 Consumer Rights

If you are a consumer in the European Union, you may also be entitled to submit disputes to the Online Dispute Resolution platform provided by the European Commission at https://ec.europa.eu/consumers/odr.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer residing in the European Union, you retain any mandatory protections provided by the laws of your country of residence.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will notify you via email or through a prominent notice on our Service.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the Service.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Maradin regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
